CER - The Wall Must Go
This synopsis presents the Critical Infrastructure Resilience Directive (CER Directive) and the KRITIS Framework Act as the German implementation of CER. CER and the KRITIS Framework Act focus on physical security and thus complement the NIS2 Directive and the BSI Act, which address cybersecurity. This synopsis should be read as a follow-up to our synopsis “NIS2 – Groundhog Day”. The network demonstrates that the artificial division of resilience into cybersecurity and physical security across two laws firstly reduces overall security and secondly is rendered absurd by the legal texts themselves. Provisions from the CER Directive can be incorporated into the NIS2 Directive with little effort, in a manner analogous to the national approach of incorporating provisions from the KRITIS Framework Act into the BSI Act. Thereafter, both the CER and the KRITIS Framework Act can be repealed.
